Are CBD Buds and Hemp Legal to Buy and Sell?
In the EU, hemp is exempt from the definition of a narcotic substance, making it legal as long as it meets specific requirements. According to LVFS 2011:10 (p. 74-75), hemp strains must be EU-approved and listed in the Swedish Board of Agriculture’s annual registry. EU-approved hemp is allowed to contain up to 0.3% THC, an increase from the previous 0.2% limit as of January 1, 2023.
This means that unprocessed products derived from EU-approved hemp—such as CBD buds and CBD hash—are fully legal to buy, own, and use across Europe, including Sweden and Denmark. These products are explicitly exempt from narcotics laws since their THC content is too low to produce psychoactive effects.
At Raw Hemp, we work with licensed hemp farmers who comply with all necessary legal requirements to grow and produce legal hemp. Under the 1961 Narcotic Drugs Convention, hemp was allowed to contain up to 0.2% THC. However, with the 2023 revision of the EU’s Common Agricultural Policy (CAP), this limit has been raised to 0.3% THC, allowing for a broader selection of hemp strains to be cultivated and used.
The hemp sold by Raw Hemp is classified as an agricultural product and meets all legal requirements for sale and use. However, while hemp itself is legal, there are restrictions on processing, and hemp extraction is not permitted in some jurisdictions.

Are CBD Oil, Vape Cartridges, CBD Snus, and Other Processed Products Legal?
On June 18, 2019, the Swedish Supreme Court ruled that CBD products must not contain any THC. This created a legal distinction between raw hemp and CBD product*. While raw hemp is legal if it contains under 0.3% THC in the EU and under 0.3% THC in the US, Sweden enforces much stricter limits. In Sweden, a legal CBD oil must contain 0.0000% THC.
